The president claimed that he lacked the authority to compel the more than a dozen states that have severe limits or complete bans on abortion to change their policies while speaking to reporters during a halt on a bike ride near his family’s beach residence in Delaware.
He remarked, alluding to the 1973 Supreme Court ruling establishing a universal right to abortion, “I can’t proclaim that we’re going to reestablish Roe v. Wade as the law of the country.”
According to Biden, Congress would need to codify that right, and people would need to elect more politicians who favor access to abortion to have a greater chance in the future.
After the decision, Biden said his administration is attempting “plenty of measures to accommodate the rights of women,” including thinking about declaring a public health emergency to free up government funds.
Advocates have advocated for such a move, but White House officials have cast doubt on its legitimacy and usefulness and emphasized that it would almost surely run afoul of the law.
